I HEART TRAVEL JAMAICA
WEBSITE AND BOOKING TERMS AND CONDITIONS
Effective date: October 8, 2026
1. About these terms
These Terms and Conditions govern use of www.iheartja.com and our authorised booking pages, direct accommodation bookings, and related services arranged through I Heart Travel Jamaica.
I Heart Travel Ltd, registered in Canada, and the Jamaican business registered as I Heart Travel Jamaica operate together under the I Heart Travel Jamaica brand. In these terms, “we,” “us” and “our” refer to those businesses in their respective capacities. For direct bookings, both businesses participate in providing the booking service and local accommodation coordination. Your booking confirmation will identify the legal contracting parties, the entity receiving payment, and any property owner or independent supplier for whom we act as an agent. Accepting payment on behalf of another party does not, by itself, change the supplier identified in your contract. “You” means the person making the booking or using our website. “Guests” includes everyone staying under the reservation. “Visitors” includes anyone entering the property who is not a registered overnight guest.

2. Your booking agreement
Your booking agreement consists of these terms, the property description and house rules presented before booking, your booking confirmation, the cancellation policy and payment schedule, and any additional terms expressly agreed in writing. Property-specific terms take priority over these general terms only where they were clearly disclosed before you booked or subsequently accepted by you. Mandatory legal rights take priority over all contractual terms. We will not introduce a new material restriction or charge after booking without your agreement, except where required by law or necessary to address an immediate safety issue.
Booking terms must be made available for you to review and accept before completing your reservation. Merely browsing our website does not create an accommodation booking or authorise payment.
3. Booking eligibility and responsibility
The person making the booking must be at least 18 years old, legally able to enter the agreement, and meet any higher minimum age disclosed for the selected property. You must provide accurate contact information, guest numbers and other reasonably necessary booking details. You must be authorised to use the payment method provided. The lead guest must ensure that everyone in their party receives and follows the applicable house rules. The lead guest is responsible for charges they agree to pay and for losses caused by their own conduct or by guests and visitors for whom they have contractually accepted responsibility, to the extent permitted by law. Bookings made for another person, companies or organised groups must accurately identify the intended occupants. A booking does not establish authority to waive another adult’s personal legal rights.
4. When a reservation is confirmed
A reservation is confirmed when we issue written confirmation and the payment required to secure it has been successfully received or authorised. An inquiry, quotation, pending payment or request to book does not guarantee availability. Quotations are subject to their stated expiry date and availability until confirmed.
Please review your confirmation promptly and notify us of any discrepancy. Failure to report an error immediately does not remove rights provided by law.
5. Prices, currency and payments
Your booking summary will identify the currency, accommodation charges, applicable taxes, cleaning charges, mandatory booking fees, additional guest charges and any other compulsory amounts. Optional services and refundable security deposits will be identified separately. Services are included only where expressly stated in your booking. Payment instalments and due dates are set out at checkout or in your written quotation and confirmation. You authorise scheduled payments only as expressly agreed through the booking and payment process. Your bank or payment provider may apply currency conversion or international transaction charges. We do not control those charges. If a required payment fails or becomes overdue, we may request an alternative payment method and provide a reasonable opportunity to resolve the issue, taking account of the arrival date. If it remains unpaid, we may cancel the booking in accordance with the agreed cancellation terms and applicable law. We will not increase an agreed price to correct our own pricing error without your consent. A material error will be addressed promptly through an agreed correction or any lawful cancellation and refund remedy.
6. Direct booking cancellation policy
For direct accommodation bookings: A cancellation received at least 30 calendar days before the scheduled check-in time qualifies for a full refund of amounts paid for the accommodation reservation, including mandatory charges collected by us for that reservation. A cancellation received fewer than 30 calendar days before the scheduled check-in time is non-refundable, subject to mandatory legal rights and the exceptions described in these terms. The deadline is calculated using the property’s scheduled check-in time in Jamaica. Jamaica time applies regardless of your location when booking or cancelling. Reservations made within 30 days of arrival fall within the non-refundable period from confirmation, subject to any cancellation rights required by law. No-shows, voluntary early departures, late arrivals and unused nights do not ordinarily qualify for refunds. A refundable security deposit is not forfeited merely because the accommodation booking is non-refundable. It will be returned or released if there are no other lawful, outstanding amounts secured by that deposit. Separately booked optional services are governed by their cancellation terms disclosed before purchase.
7. How to cancel or change a booking
Submit cancellation requests through the available booking cancellation function or email reservations@iheartja.com with your booking reference and lead guest name. The time your cancellation reaches our designated system or email address determines the applicable deadline. Our delay in acknowledging receipt will not move a timely cancellation into a later cancellation period.
Please retain a copy of your request. If you do not receive an acknowledgement, contact us to confirm receipt.
Changes to dates, property or guest numbers require written confirmation and are subject to availability, occupancy limits and any disclosed price difference. A request to change dates does not itself cancel the original booking. A date change does not automatically restart the refund period; any revised cancellation deadline must be expressly agreed in writing. Refunds will normally be initiated to the original payment method. Financial institution processing times may affect when the funds appear in your account. Any statutory refund deadline remains applicable.
8. Bookings through other platforms
If you book through Airbnb, Vrbo, Booking.com, Expedia, Homes & Villas by Marriott Bonvoy or another platform, the cancellation, payment and dispute terms accepted through that platform apply to that transaction. These website terms do not retrospectively replace your platform agreement. Property rules apply where they were disclosed and incorporated into your booking. Platform bookings should normally be changed or cancelled through the platform used to make them.
9. Security deposits and damage
The security deposit amount, collection method and timing will be disclosed before booking. A deposit may be collected as a payment or card authorisation, depending on the arrangements for your reservation.
Following checkout, we will return the deposit or initiate release of the authorisation within 14 calendar days, less any reasonably substantiated deductions permitted by the booking agreement and law.
Permitted deductions may include damage beyond ordinary wear and tear, missing items, lost keys or access devices, exceptional cleaning caused by a breach of the rules, and other agreed unpaid charges secured by the deposit. We will provide an itemised explanation and reasonable supporting evidence for deductions. We will not charge for pre-existing damage or normal use. If a claim remains unresolved, we will notify you within the 14-day period, release the undisputed balance, and retain only an amount reasonably related to the claim where legally permitted. We will provide a final accounting when the claim is resolved.
A deposit is not insurance and does not necessarily limit responsibility for proven losses exceeding it. Additional card charges require valid authorisation and must comply with applicable law and payment provider rules. Please report accidental damage promptly so we can respond appropriately.
10. Guest registration and community security
All overnight guests must be included in the reservation. We may require the full names of occupants and reasonable identity verification for booking security, property access and applicable community requirements.
Where required, identification must be presented before or at arrival. Some communities require identification on each entry. Relevant access requirements will be disclosed before booking where known.
Personal information and identification are handled under our Privacy Policy and applicable law. Please use the designated submission method for identification documents. You must not share access codes, keys or gate remotes with unauthorised persons. Failure to satisfy a material, previously disclosed access requirement may prevent entry or result in cancellation. Refund consequences will be determined under the accepted booking terms and applicable law.
11. Occupancy, visitors and events
The maximum occupancy and approved guest count must be respected throughout the stay. Children and infants must be declared even where a particular pricing policy treats them differently.
Visitors, parties, celebrations, commercial filming, photoshoots and outside vendors require written approval in advance. Some properties and communities prohibit visitors entirely.
Approval must cover the number of attendees, visiting hours, vendor access, activities and any additional charges. Permission for overnight accommodation does not include permission to host an event.
Undisclosed guests or visitors may be refused access. Additional charges must be based on rates or terms disclosed and accepted, rather than arbitrary penalties. A serious or repeated breach may result in termination under Section 20.
12. Check-in and checkout
Unless your confirmation states otherwise, check-in begins at 3:00 p.m. and checkout is by 11:00 a.m., Jamaica time. Some properties have a limited check-in window or require an in-person handover. Follow the arrival instructions and notify us promptly of delays. Early check-in and late checkout require written approval and may involve an agreed fee. They are subject to availability and are not guaranteed by flight schedules.
Unauthorised late departure may result in reasonable, documented additional costs where legally recoverable. We will not automatically impose an undisclosed penalty.
13. Care of the property and house rules
Guests must use the property responsibly, respect neighbours and staff, and follow reasonable safety instructions and disclosed community rules.
Illegal activity, threatening behaviour, harassment, excessive noise, unauthorised events and deliberate property damage are prohibited.
Smoking, vaping, pets, parking and quiet hours are governed by the selected property’s disclosed rules. Assistance animals and disability-related requests will be addressed in accordance with applicable law.
Decorations and installations require prior written approval. Do not attach tape, hooks, adhesive, nails or decorations to walls, ceilings, furniture or finishes. Any approved setup must follow the property’s requirements. Do not disable, cover, disconnect or interfere with security equipment, smoke alarms, utility systems, solar equipment or other essential installations. Use air conditioning and appliances responsibly and follow checkout instructions. Standard cleaning is included only as described in your booking; excessive cleaning may result in a substantiated additional charge.
14. Property descriptions and amenities
We aim to describe properties accurately. Review the listing for included bedrooms, amenities, accessibility features, staff services and any restrictions. Minor changes to furnishings or décor may occur. We will notify you of a known material change affecting your reservation and explain available options.
A pool, hot tub, beach, gym or other facility may be shared, privately operated or subject to operating hours and access conditions. Complimentary access does not guarantee uninterrupted availability.
Where an advertised material feature becomes unavailable, we will assess the impact and provide any remedy required by your agreement and applicable law.
15. Maintenance, utilities and access
Report problems promptly using the contact details in your arrival instructions so we have an opportunity to investigate and assist. Electricity, water, internet and other services can be interrupted by circumstances outside our reasonable control. Backup systems, where provided, may support only selected equipment and are not a guarantee of continuous service. We will take reasonable steps within our control to address problems. A minor temporary interruption does not automatically entitle a guest to a full refund, but this does not exclude a remedy for a material failure or an unsafe or unusable property. We or authorised personnel may need access for necessary repairs, scheduled services, inspections or emergencies. We will give reasonable notice and coordinate with you where practicable, except where immediate access is reasonably necessary for safety, security or to prevent serious damage.
16. Pools, hot tubs and activities
Guests must follow posted rules and use facilities appropriate to their abilities and circumstances.
Children and anyone requiring assistance must be supervised by a responsible adult. Do not assume that a lifeguard is present. Avoid swimming or operating equipment while impaired.
Please ask about accessibility or specific safety needs before booking so we can explain the property’s features accurately. Acknowledging ordinary activity risks does not waive claims arising from negligence or other liability that cannot lawfully be excluded.
17. Concierge services and independent suppliers
Airport transfers, drivers, chefs, grocery stocking, excursions, yacht outings, massage, event services and other extras are subject to availability and separate confirmation. Before purchase, we will identify the service, agreed price, inclusions, payment requirements, cancellation terms and whether it is supplied directly by us or by an independent provider. Independent providers are responsible for performing their services and may have additional reasonable participation and safety requirements disclosed before purchase. Where we act only as a booking agent, we do not control every aspect of the supplier’s performance. This does not exclude responsibility for our own representations, negligence, booking errors or duties imposed by law.
Requests and preferences are not confirmed services until accepted in writing. Availability may depend on weather, operating conditions and supplier capacity.
18. Meals, allergies and special requirements
Advise us of allergies, dietary requirements and other relevant needs before confirming food services.
We will communicate agreed requirements to the relevant provider, but an allergen-free environment cannot be assumed unless expressly confirmed by that provider. Guests should discuss significant requirements directly with the provider before service. This provision does not excuse a supplier or our business from complying with agreed requirements or applicable duties of care.
19. Travel disruption and events beyond reasonable control
Guests are responsible for passports, visas, entry requirements and travel arrangements unless a specific service has been included in the booking. Personal illness, airline delays, missed flights or a change of plans do not ordinarily alter the cancellation policy where the booked accommodation remains lawfully available and usable. We recommend appropriate travel insurance covering cancellation, interruption, medical needs and other relevant risks. Severe weather, natural disasters, government restrictions, major infrastructure failures and similar events may affect performance. We will communicate material developments and take reasonable steps to reduce disruption. If we cannot lawfully or safely provide the booked accommodation, the situation will be handled under Section 20 and applicable law. These events do not give us an unrestricted right to retain payment for services we cannot provide.
20. Cancellation, relocation and termination by us
If we cannot provide the booked property for reasons not caused by your breach, we will notify you promptly and offer an available alternative for your consideration or a refund for the accommodation and related services we cannot provide. You are not required to accept a materially different property. Any price difference must be explained and agreed. This does not limit additional remedies available under mandatory law. We may refuse access or terminate a stay for a serious or repeated material breach, non-payment, fraud, illegal activity or conduct creating a significant safety risk. Where appropriate, we will explain the breach and provide a reasonable opportunity to correct it. Immediate action may be necessary for serious threats or unlawful conduct. Any removal will follow lawful procedures. Following termination for breach, we may recover lawful, reasonable losses and apply accepted cancellation terms. There is no automatic forfeiture of every payment or deposit regardless of the circumstances.
21. Personal belongings and security
Take reasonable care of your belongings and secure the property when leaving. Report lost items promptly.
We will make reasonable efforts to help recover items found after departure. Return shipping and any agreed handling expenses are the guest’s responsibility. We do not insure guests’ belongings. Responsibility for loss or theft depends on the circumstances and applicable law; this clause does not exclude liability arising from our own fault where legally applicable. External cameras, noise monitors or other monitoring equipment, where present, must be disclosed in the listing and used in accordance with applicable law and the relevant Privacy Policy. Guests must not interfere with disclosed safety or security equipment.
22. Liability and protection of our team
We will exercise reasonable care and skill in providing the services for which we are responsible.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the booking was made or that were not caused by our breach, negligence or other legally actionable conduct.
Subject to the exceptions below, our total liability for ordinary contractual claims relating to a booking is limited to the total amount paid or payable for the affected booking. This limitation applies only where lawful and reasonable and does not reduce an express refund obligation or mandatory statutory remedy.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. To the extent legally effective, the lawful protections in this section also benefit our directors, officers, employees, agents and contractors when acting within their authorised roles. This does not excuse their own conduct where liability cannot be excluded.
23. Responsibility for third-party claims
To the extent permitted by law, you are responsible for reasonable, proven losses and third-party claims directly caused by your unlawful conduct, negligent or intentional damage, or material breach of the booking agreement. This responsibility does not extend to losses caused by our negligence or wrongdoing or that of persons for whom we are legally responsible. We will notify you of relevant claims, take reasonable steps to reduce losses, and will not agree a settlement binding you without appropriate consultation and any legally required consent.
24. Complaints and payment disputes
Please contact us promptly if something is wrong so we can investigate and seek a practical resolution.
Provide your booking reference, a description of the issue and any helpful evidence. If you are staying at the property, use the onsite or guest support contact provided in your arrival instructions.
We encourage you to contact us before starting a payment dispute, but doing so is not a condition of exercising statutory rights, card issuer rights or platform remedies.
Nothing in these terms prevents honest reviews, complaints to regulators, lawful chargebacks or access to courts. Guests and our team must provide accurate information when raising or responding to disputes.
25. Privacy and electronic communications
Our Privacy Policy explains how personal information is collected, used, stored and shared, including with booking systems, payment processors, property personnel and service providers where appropriate.
We may communicate about your reservation by email, telephone, messaging services or the booking platform. Marketing permissions are handled separately where required.
Automated systems and AI-assisted tools may help answer questions or support booking administration. If information appears inconsistent, please request human clarification. Automated replies do not themselves amend an agreed contract, and this provision does not remove responsibility imposed by law for communications made on our behalf.
26. Website use and intellectual property
You may use our website to obtain information, make legitimate inquiries and complete authorised bookings.
Do not attempt unauthorised access, interfere with website operation, introduce harmful code, submit fraudulent information, scrape personal information or misuse booking and payment functions.
Website text, photographs, branding and other content belong to us or our licensors unless stated otherwise. You may save information reasonably necessary for your personal booking, but commercial reproduction or reuse requires permission or another lawful basis. Links to our public pages are permitted where they do not falsely suggest affiliation or endorsement. Use of our logo in a way that implies a business relationship requires written permission. Third-party websites have their own terms and privacy practices. A link alone does not make us responsible for their independent content or services.
27. Reviews and guest content
You retain ownership of reviews and other original content you submit. If you submit a review directly for publication on our website, you grant us a non-exclusive licence to display that review for that purpose, with the attribution agreed at submission. We will not materially change the meaning of a review. Guest photographs, private messages and other material will be used for promotional purposes only with appropriate permission or another lawful basis. We may remove unlawful, abusive, fraudulent or privacy-infringing content. Nothing in these terms restricts truthful criticism or lawful consumer reporting.
28. Governing law and disputes
Subject to mandatory laws that apply to you or the transaction, these terms and accommodation bookings concerning Jamaican properties are governed by Jamaican law. Courts in Jamaica may hear disputes, but this provision does not remove any right you have to bring proceedings in another competent court under applicable consumer law. Nothing in these terms requires mandatory arbitration or waives any non-waivable right to a court proceeding, collective action or regulatory complaint.
29. General provisions and updates
If a provision is invalid or unenforceable, it will be severed or limited only as legally permitted, and the remaining provisions will continue to apply. A failure to enforce a provision on one occasion does not waive the right to enforce it later. A reservation may not be transferred, sublet or resold without our written approval.
These terms do not themselves govern property owner management agreements, employment relationships or supplier contracts, which require separate agreements. Extended stays may require a separate contract. Nothing here overrides tenancy or occupancy rights that arise under applicable law. We may update these terms for future bookings. The version accepted when your booking was made continues to apply unless a change is required by law or expressly agreed with you.
